Reservation, Payment, Cancellation & Legal Policy
By submitting any payment to Onlivin LLC (“Onlivin”, “we”, “us”), you acknowledge that you have read, understood, and agreed to the terms below.
1. Nature of Reservation Fee
The reservation fee is a non-refundable room hold fee.
It is:
- Not a security deposit
- Not advance rent (unless explicitly credited in writing)
- Not refundable under any circumstance
Payment secures a specific room type and requested move-in date and removes that inventory from the market.
Once paid, the reservation fee is forfeited if:
- Applicant cancels
- Applicant delays move-in
- Applicant fails to move in
- Applicant fails screening or documentation requirements
- Applicant changes plans for any reason
- Applicant disputes payment after acknowledging policy
2. Administrative, Application & Processing Fees
All administrative, application, coordination, and processing fees are non-refundable.
These fees compensate for:
- Staff time
- Documentation processing
- Scheduling
- Inventory hold risk
- Operational coordination
3. Cancellation & No-Show Policy
If the applicant cancels prior to move-in:
- The reservation fee remains non-refundable.
- Onlivin may immediately release the unit.
Failure to arrive on the confirmed move-in date without written approval constitutes voluntary cancellation.
No credits, transfers, or refunds are guaranteed.
Move-in date changes are not guaranteed and are subject to availability and written approval.
4. Payment Platform Disputes & Chargebacks
By submitting payment through Stripe, Buildium, bank transfer, or any other platform, you represent and warrant:
- You are the authorized holder of the payment method.
- You understand and acknowledge the non-refundable nature of the reservation fee.
- You agree not to initiate a chargeback or payment dispute in contradiction to these terms.
In the event of a chargeback:
Onlivin reserves the right to:
- Submit proof of acknowledgment and policy acceptance.
- Provide evidence of digital agreement.
- Recover dispute fees and administrative costs where permitted by law.
- Pursue recovery of fraudulently reversed funds.
5. No Guarantee of Tenancy
Payment of a reservation fee does not create:
- A landlord-tenant relationship
- A lease
- A tenancy
- A right to possession
Tenancy is created only upon:
- Execution of a formal lease agreement
- Completion of required documentation
- Approval by Onlivin
- Full payment of required move-in funds
6. Fair Housing & Anti-Discrimination Policy
Onlivin LLC strictly complies with:
- The Federal Fair Housing Act
- The California Fair Employment and Housing Act (FEHA)
- All applicable state and local anti-discrimination laws
We do not discriminate on the basis of:
- Race
- Color
- Religion
- Sex
- Gender identity
- Sexual orientation
- Marital status
- National origin
- Ancestry
- Disability
- Medical condition
- Source of income
- Familial status
- Any other protected characteristic under California or federal law
Roommate compatibility, shared living arrangements, and operational considerations may factor into housing decisions in compliance with applicable shared housing exemptions under California law.
7. Limitation of Liability
To the maximum extent permitted under California law:
Onlivin shall not be liable for:
- Personal scheduling conflicts
- Travel disruptions
- Visa issues
- Employment changes
- Financial hardship
- Third-party service interruptions
- Delays outside our control
In no event shall Onlivin’s liability exceed the total amount paid directly to Onlivin by the applicant.
Onlivin shall not be liable for indirect, incidental, consequential, punitive, or special damages.
8. Indemnification
You agree to indemnify and hold harmless Onlivin LLC, its members, managers, employees, and affiliates from any claims, damages, liabilities, costs, or expenses arising from:
- Misrepresentation of eligibility
- Fraudulent payment disputes
- Violation of policies
- Breach of agreement
9. Force Majeure
Onlivin shall not be liable for delays or failures caused by events beyond reasonable control, including but not limited to:
- Natural disasters
- Government actions
- Utility failures
- Labor disruptions
- Public health emergencies
10. Arbitration & Dispute Resolution
To the extent permitted by law, any dispute arising from payment or reservation shall be resolved through binding arbitration in the State of California.
You agree to waive participation in class actions or collective proceedings where legally enforceable.
This provision does not waive rights that cannot be waived under California law.
11. Severability
If any provision of this policy is found unenforceable under California law, the remaining provisions shall remain in full force and effect.
12. Governing Law
This policy is governed by the laws of the State of California.
Venue for any permitted court action shall lie in Los Angeles County, California.
